1. Who we are. LakeErie.biz ("we") is an independent online directory of Lake Erie fishing charter captains, operated by WeldonPC, Ohio. By using the site or buying anything on it, you agree to these terms.
2. We are a listing service, not a party to your trip. We don't book trips, take deposits, collect payments for trips, pass messages between anglers and captains, or take commissions. Any trip, booking, payment, cancellation or dispute is between you and the captain. We aren't responsible for a captain's services, boat, conduct or prices.
3. Listings are written by captains. Captains write their own listings and are solely responsible for them: their licenses and permits, insurance, vessel safety and inspection, crew, conduct, prices, and the accuracy of everything they post. Statements on a listing are the captain's own ("self-reported"), except where a listing is marked as coming from a state list.
4. State-list badges are dated reproductions. A badge repeats what a government agency's public list showed on the date given. It isn't an endorsement, certification or verification by us or by the agency. We republish public lists as published and don't check their accuracy. We don't inspect boats or check insurance or Coast Guard credentials.
5. Paid placements. Captain Listings, Featured Port Spots and Dockside Services Spots are paid. Featured cards are labelled "Featured · paid placement" and Dockside cards "Sponsored". The order of listings rotates daily. We don't publish reviews or ratings.
6. Who can post or pay. You must be 18 or older to create a listing, claim an entry or buy anything. You may claim an entry only if you are that person or business or are authorized by them.
7. What you may not post. No false or misleading information; no impersonation of a person, business or agency; no claims that a listing is official or approved, certified, verified or endorsed by any agency; no trademarks or slogans you don't own; no profanity, hate, harassment or adult content; no drugs, weapons, crypto, investment, MLM or loan offers; no payment instructions such as gift cards or wire-only or crypto-only payment; no photos you don't have the right to use; no web or email addresses outside the Website and Social fields. You give us permission to display, resize and re-encode what you upload for the site and its share images.
8. Our checks, reports and the freeze rule. We check listings automatically when they're saved and may refuse content that breaks these terms. Anyone may report a listing. If three different people report a paid listing within 30 days, it is hidden and its remaining paid time pauses until you fix it; an edit that passes our checks restores it with the paused time. A listing hidden three times within 90 days is frozen until its end date and cannot be restored. Photos named in a copyright notice are hidden at once. We may hide any listing that breaks these terms. Frozen, hidden or deleted listings are not refunded.
9. Payments and refunds. Prices are in U.S. dollars and paid through PayPal; we never see your card details. Items run for the period stated and do not renew automatically. All sales are final once your item is active. If we fail to activate or deliver within about an hour, you automatically receive a credit code for the full amount. 10. Reversals. If a payment is reversed or charged back, the item it paid for switches off. Two reversals tied to the same email or listing phone end that email's and phone's ability to buy on the site.
11. Removal of state-list entries. Anyone named in a state-list entry may remove it from our site for free and restore it later, as described on Help: removing or restoring an entry.
12. No warranties. The site and its information are provided "as is". Regulation summaries are not legal advice; the agency's own rules control. We try to keep dates and sources accurate but don't promise that any information is complete, current or error-free.
13. Limitation of liability. To the extent the law allows, we aren't liable for indirect or consequential losses, or for anything arising from a trip, a captain or a listing, and our total liability to you is limited to what you paid us in the 12 months before the claim.
14. Changes. We may change these terms by posting a new version with a new date. Changes don't affect items you've already paid for during their current term.
15. Law. These terms are governed by the laws of the State of Ohio.
